Detekt® identifier
Terms of Use
Effective August 16, 2026
Please read these Terms carefully. They form a binding agreement between you and Detekt® Biomedical LLC, operating under the Detekt® Home brand (“Detekt®,” “we,” “us,” or “our”), governing your use of the Detekt® Mold and Bacteria Identifier, including CHRIS (the “Identifier”). By selecting Continue after being shown the link to these Terms, you confirm that you have read and agree to them. If you do not agree, do not use the Identifier.
1. Eligibility and authority
You must be at least 18 years old or the age of legal majority where you live. If you use the Identifier for another person or an organization, you represent that you are authorized to accept these Terms for them.
2. What the Identifier does
The Identifier is an automated image-comparison and informational screening tool. It evaluates a customer-submitted photograph and customer-confirmed crop of a Detekt® test-slide surface against a limited reference library. Depending on the available visual evidence, it may show a possible visual match, two alternative possible matches, a bacteria screening level, no visible growth, an unknown result, or a request for another photograph or human review.
The Identifier does not perform laboratory testing; confirm the presence, absence, species, toxicity, viability, concentration, or source of mold or bacteria; detect every organism or environmental condition; or detect, identify, or rule out coliforms or E. coli. A displayed name is a visual reference suggestion, not a confirmed identification. An absent, low, unknown, or unsuccessful result does not establish that a surface or environment is free of mold, bacteria, allergens, toxins, or other hazards.
3. No medical, safety, or professional advice
The Identifier and its results are provided for general informational screening only. They are not medical advice, a diagnosis, an environmental clearance, a laboratory report, or a substitute for any testing, advice, inspection, or action required by law or appropriate to your circumstances. Do not use a result as the sole basis for health, safety, treatment, occupancy, remediation, insurance, employment, property, or legal decisions. The Identifier is not an emergency service.
4. Accuracy and technical limitations
Automated results can be incomplete, unavailable, or incorrect. Performance may be affected by image quality, lighting, glare, condensation, focus, camera processing, crop placement, test conditions, growth stage, mixed growth, organisms missing from the reference library, device or network failures, and other factors. The Identifier currently does not determine that multiple species are present on one slide. We do not promise that the Identifier will recognize a particular image, produce a result, or produce the same result from different photographs or crops.
You are responsible for reviewing the displayed limitations and deciding whether to rely on, retest, or disregard a result. Detekt® may abstain from providing a match when the available evidence is insufficient.
5. Your photographs and responsibilities
You are responsible for submitting a supported, accurate photograph that you own or have permission to use; keeping the complete test slide visible in clear, even lighting; confirming that the crop covers the intended test surface; and following the applicable kit instructions. Do not upload personal information, unlawful material, malicious files, or content that infringes another person’s rights.
You retain your rights in submitted content. You grant Detekt® a limited, nonexclusive license to receive, process, transmit, and temporarily reproduce that content only as reasonably necessary to operate, secure, troubleshoot, and support the Identifier. Our handling of submitted information is further described in the Privacy Notice.
6. Acceptable use
You may use the Identifier only for lawful, personal, or authorized business purposes. You may not interfere with or overload the service; bypass access, quality, or security controls; introduce harmful code; impersonate another person; scrape or systematically extract the service or reference library; reverse engineer the Identifier except where applicable law expressly permits it; or use the Identifier to create or support unlawful, deceptive, discriminatory, or harmful activity.
7. Detekt® materials and license
The Identifier, CHRIS experience, software, interface, text, graphics, reference materials, trademarks, and other Detekt® content are owned by or licensed to Detekt® and are protected by applicable intellectual-property laws. Subject to these Terms, Detekt® grants you a limited, revocable, nonexclusive, nontransferable license to use the Identifier for its intended purpose. No other rights are granted.
8. Product links and third-party services
The Identifier may display a link to a Detekt® product or a third-party site. A visual result is not a guarantee that a linked product is appropriate for every material, condition, or use, or that it will achieve a particular outcome. Product purchases are separate transactions governed by the applicable product label, instructions, warnings, checkout terms, shipping terms, and return policy. Third-party services are controlled by their providers, and Detekt® is not responsible for their availability, content, or practices.
9. Privacy and electronic communications
Detekt® records the email address entered with an analysis and limited submission and result information for product usage and result support, as described in the Privacy Notice. By using the Identifier, you consent to electronic records and communications related to the service. The share-results feature prepares an email draft and hands it to your device’s registered email handler; you are responsible for reviewing recipients and content before sending it.
10. Availability, changes, and termination
We may modify, suspend, limit, or discontinue all or part of the Identifier; update its reference library, quality gates, or output; or restrict access when reasonably necessary for security, maintenance, legal compliance, misuse prevention, or service operations. We do not guarantee continuous, secure, or error-free availability. We may terminate or suspend your access if you violate these Terms.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE IDENTIFIER AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DETEKT® DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. DETEKT® DOES NOT WARRANT THAT THE IDENTIFIER WILL DETECT, IDENTIFY, OR RULE OUT ANY ORGANISM OR CONDITION, OR THAT ACCESS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DETEKT® AND ITS AFFILIATES, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, USE, REVENUE, PROFITS, BUSINESS, OR GOODWILL; PROPERTY DAMAGE; OR COSTS ARISING FROM OR RELATED TO YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE IDENTIFIER OR A RESULT, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE IDENTIFIER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPECIFICALLY TO USE THE IDENTIFIER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These exclusions and limits apply regardless of the theory of liability and do not limit liability that cannot lawfully be excluded or limited.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Detekt® and its affiliates, officers, members, employees, contractors, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the Identifier, your submitted content, your infringement of another person’s rights, or your material violation of these Terms.
14. Consumer rights
Nothing in these Terms waives a right or remedy that cannot be waived under applicable law. Some jurisdictions do not allow certain warranty exclusions, damages exclusions, liability limits, or indemnity obligations, so portions of Sections 11–13 may not apply to you. In that event, those provisions apply only to the fullest extent permitted by law.
15. Changes to these Terms
We may update these Terms prospectively. We will post the revised effective date and provide any notice or obtain any renewed agreement required by law. Changes do not retroactively reduce rights for conduct that occurred before the updated Terms became effective. Continued use after an update takes effect constitutes acceptance only where permitted by law and after legally sufficient notice.
16. General terms
These Terms and the Privacy Notice are the entire agreement concerning the Identifier and supersede prior statements about its use. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without Detekt®’s written consent; Detekt® may assign them as part of a merger, acquisition, reorganization, asset transfer, or by operation of law.
17. Questions and dispute notice
Before filing a claim, you may contact Detekt® Customer Care at sales@detekthome.com with your name, contact information, a description of the concern, and the resolution requested. This optional process does not shorten any legal deadline or waive any non-waivable right.
